29-year-old drug offender gets suspended sentence

Luseni Moa (29) was sentenced to 11 months fully suspended in the Magistrate’s Court for possession of 0.05 grams of methamphetamine and utensils seized in Hofoa.

In the Prosecution’s summary of facts the offences were committed on the night of 24 August, 2023.

Police received reliable information that illicit drugs were being at sold at the residence of her co-accused, Sitiveni Tukuafu. The co-accused Tukuafu was first sentenced in April last year to two years imprisonment, with the last six months suspended on conditions for possesion of 4.78 grams of methamphetamine and 0.37 grams of cannabis in the Supreme Court.

Officer Fifita briefed officers from the Drugs Squad on the information that was received. Officers Fifita and 'Otuhouma then left for the residence and confirmed the information to be true.

The residence consisted of a main house and a small hut beside it. Whne Police entered the small hut beside the main house they found the accused inside lying on a bed. It was then recorded that Officer Tomu left Luseni there to look for Sitiveni Tukuafu. Then Officer Fifita later approached the residence and saw Luseni standing beside a garden outside the main house, where she was then apprehended. The illicit drugs were seized in the premises.

Magistrate Kaufusi sentenced her to 11 months imprisonment, which was fully suspended for two years on conditions on 14 January in Fasi. This was after she was found guilty in a trial.

He stated that it was clear from the evidence that the illicit drugs and utensils were found in the area, where the accused was alone in. In addition, she was living with her co accused in a hut situated at his home, where a smoking pipe was found. The accused had no criminal record.

She was sentenced her to 11 months in prison fully suspended for two years on conditions, that included not committing any offence punishable by imprisonment, she must complete 40 hours of community work, and undertake an illicit drugs course with the Salvation Army.

The drugs and utensils were ordered to be destroyed.
