Ms. Likiliki, you're right by
Ms. Likiliki, you're right by saying that, "These two issues (legalizing gay marriage and abortion) are not spelled out in CEDAW nor are they hiding in some clauses of the convention as it claimed." I tell you where they hide. They hide within the CEDAW Committee itself.
If we dig deeper into the CEDAW's performance and the CEDAW Committee's several meetings in UN during the last 30 years, we will discover how the CEDAW Committee has read more into the treaty than what the written text says, and also reinterpreting it beyond what we've envisioned and that's where those "two issues" become a significant part of the CEDAW's political agenda. We will discover how it cunningly wedges itself into its members politics. We say that the devil is in the details, but in this issue, the devil is in the interpretation and enforcement.
Dig in to the Committee's 41st session in 2008. You will find out how the CEDAW questioned seven of its members including the United Kingdom whether national judiciaries are depending on CEDAW when making legislative decisions while over-ruling or changing conflicting domestic laws. In the same session, they perceived religious people as "infringement" to women's rights. They questioned every country the extent to which they incorporated the CEDAW into their country's domestic law.
Now, Tonga is already in a culture war. Progressives academics and liberal theologians are taking side with those who would vote for legalizing of gay marriage in countries like Tonga. CEDAW can be a powerful political firepower for indoctrination of women on their behalf, and those who benefit from the CEDAW will definitely welcome this organization for financial reasons even though they don't believe in gay marriage and abortion.
Here is what I suggest. Start drafting bills that deal with the problem in detail, and also make sure that one of those bills spell out that anything in their seminars which redefine of marriage or encourage abortion is inadmissible. When that is done, then see if they can accept us. We must clear our backyard first before inviting guest. I'm sure that if they had accepted the Muslim nations while knowingly that they can't change their view of women, they would do the same thing with us.
We're ignorant to say that those two issues are not part of the CEDAW. Practical reality, they are.
