Teen discharged without conviction in robbery

A 16-year-old boy who assaulted and robbed a Chinese shopkeeper in February this year was discharged without conviction by a Supreme Court judge on November 26 in Nuku'alofa who considered that: “a conviction for such a serious offence as robbery will be far more detrimental than the injury and theft he committed to the complainant."

Risk of punishment and
Risk of punishment and ruining your life because of a conviction is meant to be a deterrent to potential offenders, and not really sure I understand the deterrent part of no convictions. The $4000 or $8000 robbery is not exactly small too. It doesn't look like the couple got any justice, except getting assaulted and robbed, and a possible $4000 still missing. Also thinking of employers who need to know people's prior convictions so they know who's a risk when it comes to entrusting them with money etc. Hopefully this is just an isolated case and not a growing pattern of convicted people coming off scot free. Youth crime is a problem though, which is something all society needs to look at.

Perhaps I am wrong, but there seems to be a pattern with the cases which Justice Niu presides in. He's very lenient for some strange reason. I think the Chinese couple should take civil action against this 16 year old.
I am glad that more people
I am glad that more people start to see Judge Niu’s pattern. It is necessary to review some cases by Niu. I think the Crown Law should appeal and the Victim should take civil action. If everyone starts to set aside the law or have their own explanation and understanding of law, then most people do not have a place to get justice.
