In an ongoing civil dispute between the Tonga Development Bank and Tatafu Moeaki and the National Reserve Bank of Tonga and others, three key matters were raised in the Supreme Court in Nuku'alofa today.
Lord Chief Justice, Malcom Bishop KC is expected deliver his ruling next week on the three matters that were raised in a Joint Court Hearing, regarding the disputes. These matters included:
- An application for a Jury for CV 24/2024
- An application for Discovery CV 24/2024
- Request for Withdrawal CV 34/2024
LCJ Bishop KC said that his ruling will be reserved until sometime next week.
The plaintiffs and defendants, were not present at today’s joint hearing, and were represented by their respective counsel.
‘Aisea Taumoepeau and Sione ‘Etika are the counsels for the plaintiffs 1, 2 & 3, (the Tonga Development Bank, its CEO 'Emeline Tuita and Board chairman Penisimani Vea).
The second case CV 34/2024 is related to media whistleblowers
The Plaintiffs (the TDB, Tuita and Vea) sued the National Reserve Bank of Tonga, its Governor and three independent journalists (Katalina Tohi, Tevita Motulalo, and Kalino Latu) for damages for loss of profit, general damages and exemplary damages, in a civil writ of claim (CV34 of 2024) filed by the Plaintiffs to the court on 6 August 2024.
