TERMS OF REFERENCE

Position: Individual Consultant – Health Advisor (HA)
Client/Employer: Ministry of Health (MoH)
Duration: One (1) year, extendable upon mutual understanding and performance for another year.
Probation Period: Six (6) months’ probation period may extend depending on candidate’s satisfactory performance. Annual performance review to determine, if contract would be renewed.
Location: Nuku’alofa, Kingdom of Tonga
Expected date of Start: Immediate Start

1. Background

The Government of the Kingdom of Tonga (GoT), through the Ministry of Health (MOH) is currently negotiating with the World Bank for funding under the 20th round of International Development Association (IDA20) for a project aimed at developing the Tonga health system. The total financial estimations are underway and likely be in between $23 - $30 million equivalent. Two broad objectives have been established:

  1. Improve health service delivery in Vava’u through an extensive design, reconstruction, renovation, and equipping of the Prince Ngu Hospital in line.
  2. Strengthen the prevention, detection and effective management of non-communicable diseases in Tonga.

The project is likely to consist of three main components, one for each of the objectives and one for the project management through a Project Management Unit (PMU). There will be a separate component that can be triggered in case there is a need to respond to an emergency.

The Department of Foreign Affairs and Trade (DFAT) of Australia has provided the government of Tonga (GoT) financial support in the value of AU$10 million which the GoT has allocated towards the development and start-up phase of the proposed World Bank supported Health Project in order to support and to expedite the implementation of the Vava’u Hospital. To start, part of this funding will be used for two key positions in an initial PMU: a Project Manager (PM) and a Health Advisor (HA). Inputs from these two resources are expected to provide a sound foundation to establish PMU, i.e. fully staffed and functional once the World Bank and GoT sign the agreement.

This HA contract will have two phases:

  1. Preparation phase funded by the GoT contracted to MoH to initiate partially operating PMU till WB signs agreement. The phase may be financed by the GoT from contracting signing and up to June 30, 2025.
  2. Implementation phase under fully operating PMU, contracted to MoH, funded from the World Bank project till project completion.

All recruitment and contracting will follow World Bank Procurement Framework for the selection and contracting of consultants to allow for continuity between the two phases. Six (6) months’ probation period may extend depending on candidate’s satisfactory performance. Subject to satisfactory annual performance review the initial contract would be renewed for one more year (total of 24 months contract), regardless of funding source under the same terms and conditions. Following this period, the conditions for negotiations on rate increases will be included in the contract. Some finer details of the TOR may be refined based on the nature of the final project agreed with the World Bank. Options for extension, if any, will follow the normal procedures under World Bank financed projects.

2. Implementing Arrangements

The MoH is the Implementing Agency (IA) for the project will chair a Project Steering Committee (PSC), which will provide strategic oversight and coordination of the project. The PSC will comprise representatives from relevant line ministries such as MoH, MOF, MOI, MEIDECC, MIA and MLNR. However, initially an Interim Project Committee (IPC) comprising of representatives form MOH, MOI, MOF, CSU and Prime Minister’s office has been established to assist with the design phase.

The PMU, when fully operational, will include project planning, coordination, financial management, procurement and contract management, environmental and social risk management, and monitoring and reporting functions. It will also encompass Health Advisory services covered under this ToRs. The Central Services Unit (CSU), established under the Ministry of Finance, will support and facilitate the Implementing Agency (MoH) with the implementation of project initially and later through PMU in an advisory and back-up role.

The Health Advisor will be part of the PMU and report directly to the Project Manager. The HA will be expected to work in close liaison with MoH in design of the project and later its implementation.

MoH will provide to the HA access to health data, reports, and other materials relevant to the assignment. MoH will provide the office space, including office furniture, access to the IT equipment, stationary, internet, communications, and related utilities for the Consultant.

The Consultant is fully responsible for the cost of local transportation (to/from the office). If required to travel to outer islands or other countries, this would be funded by the project.

3. Objectives of the Assignment

The main objectives of HA’s assignment are to work with the PM to successfully implement the design phase and then the delivery of the planned activities under the World Bank funded project. HA will be to support the MoH to successful plan and implement the Project in the way that enhances health care access, quality and efficiency in line with good practice, Tongan context and is available to the MoH for advisory support in health service planning. These objectives may be refined once the World Bank funded project is agreed.

4. Scope of Services

GoT is seeking the expertise of a Health Sector Advisor to provide strategic guidance and support in enhancing the overall performance and efficiency of our hospital facility. The Health Sector Advisor will play a crucial role in advising on best practices, quality improvement initiatives, and sustainable strategies to optimize healthcare delivery.

As a member of the PMU, the Health Advisor is required to proactively work with all relevant personnel to ensure first the design phase then the start of the implementation phase progress well and take sound consideration of appropriate health management and delivery practices suitable to the conditions in Tonga.

The Health Advisor is responsible for advising on the health details of the renovation design, equipment, and broader outreach. They will work closely with MoH, CSU and the World Bank design team to encourage suitable project design for the Tongan conditions. Once the WB funded project is signed, the HA may have specific functions within the project that will be captured within any modifications to the TOR.

5. Tasks and Deliverables:

To achieve the above objective, and under the supervision of the PMU’s Project Manager, the Health Advisor is required to undertake any reasonable task to ensure the effective implementation of the project, including but not limited to the following:

a) Project Design

Working closely with MoH staff, PM and WB design team:

  • Facilitate consultation with stakeholders in the health sector, including users of health services, especially in Vava’u
  • Review of the related literature including Tonga Health Sector Policy, Guidelines, lessons learnt and best practices.
  • Support the development and approval of the clinical services plan, human resource development and training, and biomedical equipment plan for the reconstruction and development of the Vava’u Hospital.
  • Provide input into the design of the Vava’u Hospital to ensure that it is in line with the clinical needs.
  • Ensure that design decisions and changes during construction of the Vava’u Hospital are in line with the clinical needs.
  • Provide support the development and implementation of a twinning partnership with an international health care service provider, providing comprehensive person-centered, primary health care provider for strengthening of the service delivery model for the Vava’u Hospital and related health centers.
  • Support the implementation of activities towards the strengthening of the management and organization of the Vava’u Hospital and outer island clinics towards improved service delivery and quality.
  • Support the monitoring of the human resource strengthening activities particularly in terms of advising on the human resource development and training plan to be supported by the Project.
  • Assist with design of the project results framework, collection of base line data, update, and evaluation in the clinical areas.
  • Comment on and provide feedback on drafts of the project documentation. Identify opportunities for cost optimization without compromising the quality of care.
  • Participate in Project Steering Committees.
  • Assist the Ministry of Health with the harmonization and coordination of Project activities with other development partners and their projects; and
  • Generally, advise the CEO Health on other requests for advice related to the development of the health project consistent with the objective of this assignment and wider health service delivery for the people of Tonga and in particular Vava’u.

b) Project Implementation

Working closely with the PM and other members of the PMU, support project delivery results consistent with the agreed PAD and Financing Agreement (FA) between GoT and the WB.

c) Other relevant tasks as may be directed by the Project Manager

The HA will be expected to undertake this assignment with initiative and approach in a pro- active manner. An ability to work independently as well as in a team environment will be essential. In addition, the HA shall develop professional relationships of trust and confidence and approach this assignment with flexibility and creativity including working with multiple stakeholders, such as the MoH and other stakeholders in Tonga, and donors such as The World Bank.

6. Reporting Obligations and Key Deliverables

The HA will report to the PM. The reporting deliverables of the Health Advisor will include but are not limited to:

  • Key deliverable – required data, analysis to inform project planning, and comments on draft project.
  • Input into the final Project design with project implementation strategy.
  • Monthly Work Plan in advance to be submitted to the Project Manager.
  • Monthly Progress Report against work plan, including training and capacity building activities of the MoH staff provided.
  • Provide input to project reporting as and when required by the Project Manager.
  • HA will report PM and other stakeholders timely about any associated risks, mitigation strategies and solutions to eliminate and/or minimize risks.

7. Duration of Assignment

Taking note of the two phases, the HA will initially be recruited for a period up to and until June 30, 2025, with a possible extension subject to performance appraisal and needs of the project. It is anticipated that the HA will commence as soon as possible on a full-time basis. A Time-Based Contract will be signed in which both parties will agree on a monthly rate.

The position will be subject to a probationary period of six months, with an annual performance review by the Project Manager and MoH to determine whether the contract would be renewed.

The position is based in Nuku’alofa but will require travel to the outer islands, especially Vava’u for consultations, monitoring, and data collection.

8. Performance of the Consultant

During the term of engagement, the HA shall work during office hours (8.30 am to 4.30 pm Monday to Friday) and shall diligently and effectively perform required duties to highest acceptable standard. Extra hours may need to work during site visits and any urgent situations.

MoH reserves the right to evaluate the HA’s performance and to maintain a record of the performance evaluation to refer to if the HA is considered for re-engagement.

The HA will be required to keep detailed time sheets showing inputs and deliverables resulting from each input. In evaluating the consultant’s invoices for payment, the Project manager will pay particular attention to whether time claimed for each input matches the level and quality of deliverables.

The Project Manager will formally evaluate the performance of the Health Advisor and report it to MoH’s CEO. The approved and positive performance evaluation is a requirement for any extension of the HA’s assignment.

9. Selection Criteria – qualifications, experience, and skill requirement

The HA is expected to possess the following basic qualifications, experience and skills: (Please indicate reference page numbers of your CV/resume and valid contact information of work experience for reference checks.)

QUALIFICATIONS

Education:

  • Bachelors, preferably a Master’s Degree in Health Administration, Policy, Planning or other relevant discipline from a recognized university

Experience:

  • Demonstrated minimum five (5) years of relevant and recent professional experience in the last fifteen (15) years in health sector administration, management, planning, policy and project work. (Base year 2010).
  • Demonstrated experience of one (1) year in a senior advisor role to policy makers on health sector planning, clinical service planning would be an advantage.
  • Experience with international development banks (World Bank or ADB), or large bilateral programs (New Zealand or Australian Technical Assistance Programs) would be considered an advantage.
  • Demonstrated experience working with regional organizations in the health sector (UN, South Pacific Community) on related work is also an advantage.
  • Demonstrated working experience with MoH or other health stakeholders in Tonga is desirable.

Skills & Knowledge:

Demonstrated skills and knowledge in the following:

  • Knowledge of health sector in Tonga: Background and experience in the health sector in Tonga, and/or with experience in other similar settings in the South Pacific region.
  • Analytical skills: Proven policy development, delivery and analytical skills
  • Software & Computer skills: computer skills including Microsoft Office software especially MS word, excel spreadsheets, Power Point, Outlook etc.
  • Communication skills: Excellent professional oral and written communication skills in English, including via email, audio/video conference, and face-to-face with Bank and Government officials. Proficiency in Tongan is desirable.
  • Organizational skills: Ability to work under pressure meeting project implementation timelines and deadlines.
  • Process oriented skill: Have strong skill in process development and orientation.
  • Teamwork: Effective teamwork skill, and collaboration with a range of stakeholders in an inclusive manner, is necessary.
  • Work Ethics: Proven high level of personal integrity and commitment to national and international professional work ethics and standards.
  • Site visit and project monitoring skill: Willingness to travel within Tonga (i.e. to the outer-islands) for visiting sites and monitoring project works.

One of the main objectives of PM’s assignment is to be responsible and accountable to the CEO of MoH in the project management and coordination first of the design phase, then the implementation phase based on the agreed Project Appraisal Document (PAD) and Financing Agreement (FA) between the GoT and WB.

Other objectives are to ensure that:

  • the PMU collaborates with the WB and MoH, MOF, and other agencies as and when needed (MOI, CSU etc.) on the development of Project strategic documents.
  • The project is implemented in accordance with the various Legal and Financing Agreements.
  • The objectives of the Project, procurement plans and action plans and the provisions of other relevant strategic, and legal documents are implemented in a timely and cost-efficient manner.
  • Project expected outputs and deadlines contribute to mutually agreed milestones and key performance indicators.

4. Scope of Services

The PM will be responsible for management of day-to-day tasks for the PMU. In the first phase these will be limited, with a strong focus on supporting the effective design of the project. Once the project is approved, the scope of the PM will include the management of the implementation of project activities, human resources, planning, contracts, finance, procurement, communication, reporting and M&E tasks, working in close collaboration with the rest of the PMU Team.

5. Duties and Responsibilities:

To achieve the above objectives, Project Manager is required to undertake any reasonable task to ensure the effective design and implementation of the project, including but not limited to the following:

1. Ensure all activities are consistent with the Legal Agreements, approved Procurement Plan, Project Operations Manual (POM), Environmental and Social Management Framework (ESMF) and M&E frameworks as applicable.

2. Collaborate with the WB and MoH, MOF & CSU, and other agencies as and when necessary, on the development, updating and revision of Project documents including the Procurement Plan, Implementation Plans, POM, Work Schedules, Guidelines, standard templates issues by CSU, and other relevant Project documents including (but not limited to).

  • Prepare the Annual Work Plans and Budget and update the procurement plan for the project including all components, in consultation with the relevant stakeholders as needed.
  • Prepare POM and updating of the Manual as required,

3. Overall responsibility for Project reporting functions including (but not limited to):

  • Preparation and submission of status reports, progress report, updates on the most recent aide-memoire action plan, six monthly reports and any other relevant reports including financial reports to the CEO, MoH, WB and the MOF on the performance and progress of the Project and its implementation.
  • Supervision and oversee of the preparation of financial management and procurement reports.
  • Oversee for adequate reporting of all M&E and safeguards activities.
  • Overall responsibility for ensuring all project reports and files is kept up to date; and
  • Ensure accuracy of records of inventories of supplies, documents to be made under the Project.

4. Ensure overall quality control and timely implementation of Project activities in accordance with operational procedures including procurement, financial management, social and environment safeguards, and contract management including (but not limited to):

  • Ensure that appropriate standards of Governance are applied at all times on all activities generated by or related to the project.
  • Lead preparation of different project documents for the various project activities and ensure this is undertaken in a timely manner, with input from relevant stakeholders in PMU and/or government as needed.
  • Supervise the procurement and financial management activities in accordance with the Procurement and Budget Plans and the relevant procedures and guidelines of the GoT and the WB.
  • Ensure the routine financial and disbursement monitoring reports are prepared in accordance with the country requirements acceptable to the WB, to facilitate the submission of financial withdrawal applications to the WB.
  • Monitor and report on the project progress and performance against the project timeline using a project Gantt chart, as applicable, to comprehensively track planned vs. actual progress for all project activities, highlighting and explaining delays if any, and taking corrective measures as needed.
  • Oversee, monitoring and the management of contracts under the Project ensuring the due diligence checks are undertaken, and that payments are correctly made in a timely manner.
  • Coordinate the handling of grievances according to the approved guidelines.

5. Lead the PMU and all consultants recruited by the Project and provide them with guidance and support as needed on project procedures and policies. This includes (among other things):

  • Supervise the deliverables of PMU and consultants or other consultants to be engaged under the project, identify bottlenecks and constraints, and provide recommendations to address them.
  • Oversee and monitor the preparation of the Procurement Plan prepared with support from the Procurement Officer with regard to thresholds, and component activities and monitor the use of STEP and execution of the procurement process, ensuring that the WB regulations and guidelines are complied with.
  • Oversee and monitor the financial management of the Project ensuring, with the support of the FM Officer, compliance with the WB regulations and guidelines and the relevant Tongan laws are complied with.
  • Supervise and monitor the management of contracts under the Project, with the support of the Contracts/Procurement Officer, throughout the duration of the contracts ensuring the due diligence checks are undertaken and that payments are correctly made.
  • Monitoring and evaluation of project activities and reporting, with support of the M&E Officer, ensuring that activities are in line with the Project objectives, plans and key performance indicators; and;
  • Administration & Management of PMU consultant time inputs, ensuring including leave entitlements/days off etc are appropriately managed and documented.

6. Collaborate with the CSU on a regular basis including:

  • Ensure that project team members seek on-demand support from the CSU as required.
  • Meet at regular intervals (at least monthly) with the Program Manager of CSU to agree upon levels of support required in the coming period including participation in formal training / workshops organised by the CSU or the WB; and
  • Communicate between MoH, the WB and the CSU documents for agreement, clearance, approval, endorsement and seek the views of the CSU before submitting requests for no objection to the WB on complex procurement related and other matters. This includes at a minimum, cc CSU in to submission of all formal documents for no-objection, and reports to the WB Team.

7. Ensure good communications and information flow between stakeholders/agencies involved in Project implementation including (but not limited to):

  • Undertaking the necessary liaison with other donor agencies, Ministries and with other relevant Projects within Tonga and report to MoH and the WB; and,
  • Advocacy related to the Project, especially the development and maintenance of partnerships with related projects and Programs and institutions engaged in project.

8. Prepare and coordinate completion report activities (if applicable/required).

9. Assist with the implementation of follow up actions resulting from WB technical and implementation support missions, regular teleconferences, and progress reports; it is expected that the PM will assist and coordinate through providing data as required by the WB in preparation of PAD and Financing Agreements.

10. Other duties applicable to the Project Manager as delegated by the CEO for MoH.

The PM will be expected to undertake this assignment with initiative and approach the role in a pro- active manner. An ability to work independently as well as in a team environment will be essential. In addition, the PM shall develop professional relationships of trust and confidence and approach this assignment with flexibility and creativity including working with multiple stakeholders, such as the MoH and other stakeholders in Tonga, and donors such as WB.

The PM will have a key responsibility for supporting smooth operations of the PMU, to build the team spirit and ensure that all work collaboratively avoiding silo mentalities.

6. Reporting Obligations and Key Deliverables

The PM will report to the CEO of MoH. The reporting deliverables of the PM will include but are not limited to:

  • Monthly Work Plan in advance to be submitted to the PM
  • Monthly progress Report against work plan, including training and capacity building activities undertaken.
  • Key deliverables – as listed in the scope.
  • Project reporting as required by the PAD and FA.
  • Provide input to project reporting as and when required by the IAs Sr. Management and CSU PM.
  • PM will report IA Sr. Management, CSU PM and other stakeholders timely about any associated risks, mitigation strategies and solutions to eliminate and/or minimize risks.

9. Selection Criteria – qualifications, experience, and skill requirement

QUALIFICATIONS

Education: (20%)

  • Minimum Bachelor Degree, preferably a Master’s in Project Management / Administration, Planning, Engineering, Economics, or other relevant discipline from a recognized university.

Experience: (50%)

  • Demonstrated minimum five (5) years of work experience in project management and/or contract management in infrastructure projects, preferably with at least some experience in the health sector in the last fifteen (15) years. (Base year 2010).
  • Demonstrated minimum three (3) years in donor funded projects in the Pacific Region or similar small island states context.
  • Demonstrated experience of project construction or contract management for projects with works budgets in excess of USD 2 million
  • Demonstrated familiarity with WB procurement, financial management and safeguards policies and guideline.
  • Proven experience in managing projects with diverse stakeholders and meeting deadlines.
  • Demonstrated and hands on experience implementing and managing contracts.

Skills & Knowledge: (30%)

Demonstrated skills and knowledge in the following:

  • Communication skills: Excellent professional oral and written communication skills in English, including via email, audio/video conference, and face-to-face with Bank and Government officials. Proficiency in Tongan is an advantage.
  • Organizational and team management skills: Ability to work effectively in building and leading a team, to plan and complete assignments in a timely manner, and report effectively on the work performed.
  • Analytical skills: Understanding of financial and economic concepts and ability to analyse issues related to public sector planning and health sector management.
  • Computer skills: Ability to effectively use email and Microsoft Office applications (Word, Excel, PowerPoint, Outlook); skill in MS Project or equivalent will be added advantage.
  • Reporting skill: Demonstrated high-level reporting skills.
  • Administrative skill: Demonstrated skills in leadership, coordination and mentoring of the staff, team building, and resolving issues that might undermine effective team working.
  • Work Ethics: Proven high level of personal integrity and commitment to national and international professional work ethics and standards.
  • Process oriented skill: Have strong skill in process development and orientation.
  • Teamwork: Effective teamwork skill, and collaboration with a range of stakeholders in an inclusive manner, is necessary.
  • Site visit and project monitoring skill: Willingness to travel within Tonga (i.e. to the outer islands) for visiting sites and monitoring project works.

Interview: Client may inform potential candidates for an interview to validate all above as required.

Under the above selection criteria, the recent completion of relevant courses will be considered as an advantage. For example, the Bank has made available free and online courses and candidates that invested their time upskilling themselves will be compensated. This includes WB project learning modules, including the Certificate Program in Contract Management (CPCM)- https://www.procurementlearning.org/aim-of-the-course-3/.
