The Government of Tonga has received financing from the World Bank toward the cost of the Tongafish Pathway, and intends to apply part of the proceeds for the following consulting services.

The consulting firm (herewith called the “Consultant”) is to conduct a review of the Fisheries Management Act 2002 and Aquaculture Management Act 2003. The Consultant will review the existing institutional and legal framework to identify gaps, determine the extent of constraints or mobilization of long-term provisions and provide recommendations and support implementation of possible reforms.

The Consultant is expected to work closely with the Ministry of Fisheries Legal Officer, line ministries and regional partners such as FFA, SPC, WCPFC, MPI, FAO etc to ensure that the national legal mechanisms are aligned with regional policies and frameworks.

More specifically, the consultant is expected to provide the following services:

  1. Review, analyse and identify gaps in the Fisheries Management Act and Aquaculture Management Act for enforcement.
  2. Assist with providing recommendations to the revisions of the two Acts and assist with preparing cabinet submissions with implementing and working towards and improving the legal framework keeping in view Government of Tonga obligations under international, regional and Tongan laws and regulations.

The Ministry of Fisheries now invites eligible Consultants to indicate their interest in providing the Services. Interested Consultants should provide information demonstrating that they have the required qualifications, relevant experience to perform the Services and to address the Evaluation Criteria outlined in the TOR.

The attention of interested Consultants is drawn to paragraph 3.14, 3.16 and 3.17 of the World Bank’s Procurement Regulations for IPF Borrowers November 2020 (“the Regulations”), setting forth the World Bank’s policy on conflict of interest.

The best qualified firm to carry out the services will be selected in accordance with the Consultant’s Qualifications Based Selection (CQS) method set out in the Regulations, and based on the following criteria: key experts with Degree in Law or related areas acceptable to Client; Minimum of five years in the legal advisory role in areas related to laws related to Fisheries and Aquaculture; Minimum of two assignments related to legal framework of fisheries management, or similar, in the last five years; and Experience of work in countries with conditions similar to the ones in Tonga.
