CONDITIONS OF BID

1. Summary of Sale

Tonga Power Limited (TPL) invites bids from the public for the purchase of motor vehicles(s) currently owned by TPL.

Key details:

Vehicles are offered on an “As-Is, Where-Is” basis.
Bidders are responsible for the inspection, removal, transportation, registration and insurance of the purchased vehicles.
TPL reserves the right to inspect all vehicles prior to sale and reject any bids that do not meet the stated requirements.
Successful bidders must remove vehicles from TPL premises within the timeframe specified in the contract.

3. Requirements for Valid Bid

To be considered valid, a bid must:

Include a duly completed BID DECLARATION FORM and copies of TWO VALID FORMS OF IDENTIFICATION (e.g. Passport, National ID, Driver’s License)
Include a duly completed BIDDING SCHEDULE
Be submitted in accordance with these CONDITIONS OF BID

Bids failing to comply with any of these conditions will be rejected

4.Lodging of Bids

Bids MUST be clearly labelled “Bid for Motor Vehicle” and addressed to the Chief Executive Officer, Tonga Power Limited, Nuku’alofa, Tonga.
The deadline for submission of bids is 4:00PM on 30^th January, 2026. Bids received after this time will not be considered.

5. Costs

All costs incurred in preparing and submitting a bid are borne entirely by the bidder.
TPL will not be responsible for any costs, expenses, or losses incurred in the preparation of bids

A bid cannot be withdrawn within sixty (60) days after the closing date
Bid withdrawal is permitted only within this period, with written notice submitted to TPL

9. Acceptance of Bid

Bids shall remain open for acceptance for a minimum of thirty (30) days from the closing date.
TPL reserves the absolute right, at its sole discretion, to accept or reject any bid, including the highest bid. Only the successful bidder will be notified by Tonga Power Limited of the acceptance of their bid.
TPL may accept bids for all or a portion of the vehicles offered
Acceptance of a bid by TPL constitutes a legally binding agreement
Sub -contracting or assignment of bids is prohibited.
Successful bidders are responsible for all associated costs, including damages, transport and insurance.

10. Bidder Identification Requirement:

All bidders must provide valid identification at the time of bidding. Acceptable forms of identification include a Passport, National ID, or Driver’s License. Bidders are required to present any two (2) of these forms of identification as proof of identity.

11. Authorization for Collection:

In the event that the successful bidder wishes to authorize another person to collect the motor vehicle on their behalf, the bidder must provide Tonga Power Limited (TPL) with a written letter of authorization specifying the authorized person. The authorized person must also present a valid form of identification at the time of collection. TPL reserves the right to refuse release of the vehicle if these requirements are not met.

We are truly authorized to execute this document on behalf of the bidder; and
We have read and understand the bidding documents includingthe conditions of the bid and contract agreement; and
The bidder agrees to be bound by the terms and conditions of the bidding documents, including the Conditions of Bid and contract agreement; and
Acknowledge that the motor vehicles which are the subject of this bid;
- Were used by TPL operations and are offered for sale on an “As-Is, Where-Is“ basis, with no warranty or guarantee
- Are located in Tongatapu and are available for inspection and collection at Matatoa, Tofoa, Tonga Power Limited Headquarters
The contents of this bid, as submitted by the bidder are true, accurate and correct in all respects; and
We agree that in the event that the bidding is accepted, the bidder will be deemed to have entered into a legally binding relationship with Tonga Power Limited for the provision of services in accordance with the contract agreement.
