Witness tells of alleged beating of Kali Fungavaka outside bar [1]

A witness at the Preliminary Inquiry into the death of New Zealand Police officer Kali Fungavaka alleged she saw the victim being punched twice by accused police officers in front of the Langafonua Centre opposite Timeout Bar, in central Nuku'alofa.

The inquiry entered its fourth and final day today, February 28, before Magistrate Salesi Mafi.

This morning the witness said she was sitting inside her vehicle in front of Friends Cafe with some other friends looking at the bars on the night of August 17, 2012, whe she saw a commotion outside Timeout Bar. There were three police vehicles triple parked in front of the bars and she saw police officers getting out of the police vehicle. "There was a group of police officers and someone was inside and there were struggles, which caught my attention," she said.

The witness said she then saw three people who were struggling, crossing the road in front of the Langafonua gate.

She told the court there were initially three police officers who were with the victim when they crossed the road from the bar but then one left and the remaining two accused officers were left to escort the witness back to the police station.

She said she saw that the victim was punched twice. He remained standing after the first punch, but when he punched twice he fell onto the gate.

"I also saw a shining black object being held up by one of the accused officer's in his right hand and when he put it down towards the back of the victim's head or back of his neck," he fell down. "The officers then lifted him up and continued to escort him down to where we parked," she said.

She saw that the accused officer who held up the shining black object put the object back to his side, into his pocket or the side of his belt, but she was not able to see what the black object was.

The witness said the accused officers saw them inside the vehicle and instead of walking straight on the footpath they crossed onto the road and came beside her vehicle. "I got up to have a better look but then the two officers looked at me angrily so I popped back inside," she said.

"I heard Kali say what have I done. Kali looked like a strong man because they were struggling for around five minutes at the front of the centre and when the two officers escorted him past my vehicle they were grasping for breath," she said.

When she was crossed-examined by a defence counsel, that there was no black object, and the other person who was with her in the vehicle stated in her evidence, that she did not see anything. 

The witness was adamant that she saw a shining black object being lifted by one of the accused officer and when it went down on the back of the victim's head or neck, he fell down and there were two punches to the victim as they struggled in front of the centre.

She told the court she was 100 percent sure of what she saw happen that night.
