Crown appeals against quashing of Dalgety indictment [1]

THE Tonga Court of Appeal 2011 Session will hear only eight appeal cases next week, including an appeal by the Crown Law against a judgment by Justice Robert Shuster to quash a perjury indictment against Lord Dalgety.
The Crown is appealing against Justice Robert Shuster's decision to
quash the perjury indictment on November 1, 2010 because he claimed the document was invalid and incorrect as it was not signed or dated.
The perjury charge relates to a statement made by Dalgety at the Royal Commission of Inquiry into the sinking of the MV Princess Ashika in January 2010.
The Chief Registrar of the Supreme Court, Manako Vi, said that the Court of Appeal will sit only for a week, from April 11 to April 15 when judgments will be delivered.
It is understood that a second Court of Appeal session will be held later in the year, in October.
The Appeal Judges are Mr Justice James Burchett, Mr Justice Peter Salmon, and Mr Justice Michael Moore.
