Marijuana case dismissed [1]

The first Marijuana case for 2004 was dismissed by Chief Justice Ward at the Supreme Court Nuku'alofa on January 20 because of the irregularities and unreliable evidence provided by the police.

The case was brought by the Crown against Uikilifi Vea of Ha'ateiho, after his house was searched by the police on 17 January 2001 who seized number of small bags of which they claimed contained marijuana and an instrument for the smoking of marijuana.

Chief Justice Ward dismissed the case on the grounds that there were discrepancies by the two policemen who searched Uikilifi Vea's house. While Police Constable Vake told the court that they found a packet of Port Royal tobacco, containing two plastic bags with over a thousand marijuana seeds, Lance Corporal officer Heimuli testified that there were only eight marijuana seeds in one of the plastic bags.

While there were differences in the reports of the two policemen, the actual sample that was given to a medical officer for testing was reported to contain only nine marijuana seeds.

If there was not enough irreglarities already surrounding this case, the last straw was that PC Vake testified that he did not know who took the oath for the affidavit to obtain the Search Warrant to search the house of Uikilifi Vea.
