Former Revenue CEO granted eased bail conditions [1]

'Anisi Kulufeinga Bloomfield, a former CEO of the Ministry of Revenue and Customs, who is to be extradited to Fiji to be tried for theft and dishonesty, allegedly committed between 2011-14, remains on bail in Tonga.

Hon. Mr Justice Niu ruled on amended bail conditions on July 15, after a hearing at the Supreme Court in Nuku'alofa.

The Crown submitted that the accused had breached his previous bail conditions and had not reported to Police on some of the days he was required to.

However the judge said the accused had produced medical certificates, which confirmed that he was sick on four of the six days he had not reported to the Police.

"I am not convinced that the accused had breached the conditions of his bail, or that he has breached them substantially to warrant refusal of his bail," said Justice Niu.

In consideration of medical conditions, and that he was not a flight risk with the present border lockdown in force, he ruled that the requirement for reporting to the Police Station be reduced to every 14-days instead.

He noted the accused was already on bail when his application for habeas corpus to stop his return to Fiji was dismissed by the court on June 9. The accused was ordered to be returned to Fiji to be tried on both the two offences, of which he had been charged there.

However, on his bail ruling, the judge was mindful that before this matter came to this Court in March this year, the accused had been required to report daily to the Police from at least January 2020, and that when bail was agreed before him, it was agreed that the reporting be done once a week.

In addition, every person has a right to bail which may only be withheld in circumstances provided for in the Bail Act.

He then ordered that the accused be granted bail on the same terms and conditions granted to him on March 5, 2020. But now he is to report to the Nuku'alofa Central Police Station between 9:00am to 11:00am on every alternate Friday, starting July 24.

The accused and his two sureties were also ordered to sign a recognizance, stating “that the accussed shall attend at such sittings that this Court or the Court of Appeal shall direct and duly conveyed to him.”


It ws alleged in Fiji that the accused committed these offences, while acting as Head of the Oceania Customs Organisation in Suva.

He returned to Tonga and was appointed CEO of Revenue and Customs in 2015 by the former government.

Meanwhile, Tonga's borders has been closed since late March due to COVID-19.
