Men jailed for beating and fracturing victim's jaw [1]

Two men were jailed by the Supreme Court for serious causing bodily harm to a victim whose jaw they fractured by kicking him.

Hon Mr Justice Cato on July 10 sentenced Tausinga Taufateau and Piupiu Katoa to 22-months imprisonment.

They had both pleaded guilty to the offences.

The Court heard on August 24, 2019 at Fanga, the accused wilfully and without lawful justification caused harm to Lolani Takau when they repeatedly kicked him, fracturing his jaw. 

The Crown submitted the aggravating factor was that both intoxicated when they committed the offences.

The seriousness of the offending was that the victim was on the ground and was repeatedly kicked on the head. He suffered a fractured jaw and required dental bridal wires, said the Crown.

The judge sentenced the accused to 22-months but suspended the final 12-months on conditions that they are not to commit any crimes and will be placed on probation, during the suspension period, among others.

Meanwhile, their sentence was backdated to when they were first detained in police custody.
