Court of Appeal to hear TongaSat appeal in April [1]

Tonga’s Court of Appeal from 8-18 April will hear an appeal by TongaSat against a Supreme Court decision that declared that the multi-million Chinese aid fund grants paid to the company in 2008 and 2011 were unlawful.
 
The Friendly Islands Satellite Communications Ltd (TongaSat) vs Pohiva and Kingdom of Tonga in its appeal is seeking to overturn judgments by Lord Chief Justice O.G. Paulsen in August and September last year, in favour of an action brought by the Public Service Association (PSA), 'Akilisi Pohiva and Kingdom of Tonga.  

The judgments had declared that multi-million in aid grants received by the Kingdom of Tonga from the People's Republic of China in 2008 was a “grant” and accordingly “public money” under the Public Finance Management Act.

Meanwhile, a total of 16 appeals are set down to be heard by judges Hon. Justice Kenneth Handley from Australia, Hon. Justice Sir Peter Blanchard and a new Court of Appeal Judge, Hon. Justice Tony Randerson both from New Zealand.

Other appeals include Tonga National Rugby League Board against their dismissal and a long ongoing court battle by former chief Secretary Busby Kautoke against the Public Service Commission.
