Young driver not guilty of manslaughter [1]

Malakai Paua (22) was acquitted by Mr Justice Anthony Ford on the charges of manslaughter by negligence and driving without due care.

It was alleged that on the night of 5 November 2004 at the Bypass Road, Mataika, that Malakai was the driver of a motor vehicle causing the death of Faka...’osi. Tau'alupe (12).

The defendant was found not guilty in both charges due to insufficient evidence provided by the Crown.

The criminal trial was held for two days on September 21 ...–22 in the Nuku'’alofa Supreme Court. The counsel for the Crown was Sione Sisifa and representing the defendant was Siosifa Tu'utafaiva.
