Malakai Paua (22) appeared in the Nuku'alofa Supreme court today, charged with manslaughter by negligence.

It is alleged that Paua, was the driver of a car that struck and killed Faka'osi Tau'alupe (12) of Mataika on the Bypass Road on 5 November 2004.

Paua was also charged with driving without due care or attention to Faka'osi who was using the road.

The Crown filed the alternative charge in case the accused was found not guilty on the charge of manslaughter by negligence.

The trial is presided over by Mr Justice Anthony Ford. The legal counsel for the Crown is Sione Sisifa, and the defendant is represented by Siosifa Tu...’utafaiva.

The Crown will call eight witnesses and the trial is expected to finish tomorrow, Thursday, September 22.
