Vacancies - Attorney General's Office 

This serves to invite interested candidates to apply for the following vacant positions that are available at the Attorney General's Office. 
 
The vacant positions are as follows: 
  1. (Ix) Assistant Senior Crown Counsel (Band G);
  2. (Ix) Assistant Crown Counsel (Band I); and
  3. (Ix) Assistant Crown Counsel (Band I).
The job description outlining the duties and requirements for the posts are attached herewith for information. 
 
Please note that public service employees who wish to apply must submit their application through their respective Chief Executive Officers.

JOB DESCRIPTION - ASSISTANT SENIOR CROWN COUNSEL

POST:

Assistant Senior Crown Counsel

RESPONSIBLE TO:

Solicitor General

SUPERVISOR:

Solicitor General

DUTIES:

  • Criminal Prosecution:
    • More complex assault cases (Multiple Manslaughter; Multiple Manslaughter by negligence etc);
    • More Complex sexual offences (Multiple Rape; Indecent Assault of children; Incest etc);
    • More Complex property offences (Robbery; Assault with intent to rob etc);
    • More Complex drugs cases (Growing cannabis; making cannabis oil etc, Large Volume of Drugs etc);
    • More Complex fraud cases (Counterfeit; Embezzlement; Falsification of Accounts etc) More Complex public policy cases (Fisheries processing establishments)
  • Civil Litigation:
    • More Complex claims against Police;
    • More Complex torts cases;
  • Land Claims:
    • More Complex land disputes
  • Government Legal Advice:
    • More Complex legal advice
  • Prepare Brief of Files for Grades 5 and 6 cases;
  • Act as junior counsel in Grades 5 and 6 cases;
  • Provide legal opinions for Grades 5, 6 and 7 work;
  • Deal with complex mutual assistance in criminal matters requests;
  • Deal with complex extradition requests;
  • Organise Weekly Court appearances;
  • Approve Briefs and Indictments for Less Complex criminal cases.

AUTHORITY:

  • File Indictment for more complex criminal cases;
  • File statement of defences for assigned civil and land cases;
  • Dispatch legal advice for assigned legal advice requests;
  • Recommend plea bargaining/Crown offering no evidence/ Adult diversion on Grade 4 cases and below;
  • Recommend immunity from prosecution;
  • Recommend mediation;
  • Recommend adult diversion;
  • Conduct jury trials;
  • Appear and make submissions before the Court of Appeal on minor appeals (e.g. appeals against sentence);
  • Sign off Cabinet submissions (with Grade 6 approval);
  • Approve indictments for less complex matters (Housebreaking, theft).

QUALIFICATION:

  • Bachelor of Laws degree from a common law jurisdiction;
  • More than 5 years' work experience post admission to the legal bar; Experience in criminal prosecutions, civil cases and land cases;
  • Conducted jury trials;
  • Experience in drafting legal documents;
  • Understanding of Tongan legal system and practice;
  • Understanding of Government system, procedures and practice;
  • Excellent computer skills;
  • Experience in public speaking;
  • Fluent in Tongan and English;
  • Performs under pressure;
  • Dedicated;
  • Innovative;
  • Organised;
  • Time Management skills.

JOB DESCRIPTION - ASSISTANT CROWN COUNSEL

POST:

Assistant Crown Counsel

RESPONSIBLE TO:

Solicitor General

SUPERVISOR:

Solicitor General

DUTIES:

  • Conduct Criminal Prosecution in the following criminal cases:
    • Less complex assault cases (GBH, Bodily Harm);
    • Less complex sexual offences (Indecent Assault);
    • Less complex prope1iy offences (Robbery, Housebreaking, Theft etc);
    • Less complex drugs cases (Possession and Growing Illicit Drugs).
  • Conduct minor Criminal Appeal cases from the Magistrates Court;
  • Prepare Brief of Files for Grades 3 to 6 cases;
  • Act as Junior Counsel for in Grades 3 to 6 cases;
  • Provide legal opinions for Grades 5 and 6 legal work;
  • Deal with normal and complex Guardian Ad Litem matters (disputes over custody etc).

AUTHORITY:

  • Recommend draft indictment on Grade 3 and above cases;
  • Recommend Charge Bargaining/ Crown Offering No Evidence/ Adult Diversion on Grade_2 Cases.

QUALIFICATION:

  • Must have a Bachelor of Laws degree from a recognised common law tertiary institution and admission to the legal bar in a common law jurisdiction;
  • Completion of Professional Legal Studies Course from a recognised common law institution/ jurisdiction;
  • Understanding of Tongan legal system and practice;
  • Understanding of Government system, procedures and practice;
  • Excellent computer skills;
  • Experience in public speaking;
  • Fluent in Tongan and English, written and oral;
  • Performs under pressure;
  • Dedicated;
  • Innovative;
  • Organised;
  • Good Time Management skills.
