Tonga Court of Appeal decides 7 cases [1]

THE first session of Tonga's Court of Appeal fpor 2011 ended on Friday, April 15 with the delivery of judgments at the Supreme Court of Nuku'alofa after one week of sitting.
The Court of Appeal presided over by Justice James Burchett, Justice Peter Salmon and Justice Michael Moore dealt with seven appeals, including four civil cases, two criminal cases and one divorce case.
Of these appeals two appeals were allowed, three cases were dismissed and one case was adjourned to the next sitting of the Court of Appeal.
The appeals heard included two criminal cases: Crown v Ramsay Robertson Dalgety; and Crown v Kapuana 'Unga and Naomi Taulafo, which were both upheld.
Civil appeals dismissed included Hupeto Kaitapu and others v ANZ; and Ha'apai Marine Ltd v ANZ.
The divorce appeal between Manavahe Ata and Halamehi Fa'ase'e was dismissed.
In the meantime a civil appeal by Juergen Wolf and Brigitta Wolf v Franz Strauss and Gudrus Strauss was adjourned to a second sitting.
The second 2011 Court of Appeal session will be held later in the year, in either September or October.
